Spot the difference between inventor(s) and applicant(s) in a patent application.

Inventor(s)

Those are the ‘true and first inventor’ who involved in a particular invention.

Applicant(s)

Those who owns the rights of the patented invention. They have to apply for the patent in patent office. They have the rights to sell/ manufacture/ export/ licensed to others/ collect the royalty from others if infringed. Their name will be published in the Patent certificate as Patentee.

WHAT IS THE PROCEDURE FOR PUBLISHING A PATENT APPLICATION ?

The patent application will be automatically published after 18 months from the date of filing of a patent application.

In case, if the applicant wishes to publish earlier i.e. within 18 months from the date of filing of a patent application, then the applicant have to submit the Form 9 along with the prescribed fees as mentioned in the first schedule of ‘The Patents Act, 1970’.
